Eligibility: This Go Kinetic Giveaway (“Giveaway”) is only open to United States residents of the following states: Alabama, Arkansas, Georgia, Iowa, Kentucky, Minnesota, Mississippi, Missouri, Nebraska, New Mexico, North Carolina, Ohio, Oklahoma, Pennsylvania, South Carolina, and Texas (“Eligible State(s)”). You must be a legal US resident 18 years of age or older at the time of enter (“Participants”). Access to Kinetic broadband services are required to use the prize. Part of the prize package will provide or give credits for Kinetic broadband services; however, Winner(s) must use services at a residential location which qualifies to receive Windstream broadband services to effectively use the prize. Failure to be at a location to which Windstream broadband services can be delivered is a basis for disqualification. Winner’s use of Windstream’s Services are subject to Windstream’s standard terms and conditions which can be found at https://www.windstream.com/about/legal/Terms-and-Conditions and any other applicable terms and conditions which may apply to the services won. Employees of Windstream their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each, are not eligible to participate in the Giveaway. Agreement to Rules: By participating, you agree to be unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Kinetic as final and binding as it relates to the content. The Giveaway is subject to all applicable federal, state and local laws.

Giveaway Period: Entries will be accepted online starting June 23, 2021 and ending July 23, 2021. All online entries must be received at the end of each day by 11:59 p.m. EST.

How to Enter: Participants may enter by filling out an entry form by one of the two methods: 1.) by filling out a popup form within the Go Kinetic mobile app or online account management tool (while the popup is active) or, alternatively, 2.) by using the AMOE process below. Participants may enter the Giveaway one time via each method described above, but may not enter more than once using any method, and you must fill in all of the information requested. Participants are solely responsible for any data or wireless charges used to enter the Giveaway. No purchase necessary. No entry fee required. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Kinetic. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Windstream. Alternate Method of Entry (“AMOE”). You may also enter the Giveaway by mail as follows. On a plain 3” x 5” index card, legibly handprint or type your first and last name, date of birth, complete address, city, state, zip code, home phone number (including area code) and email address (if any), and mail your completed card to: Kinetic, Attn: Kinetic Kinetic Marketing (C/O of Chris Beniche), 4001 N. Rodney Parham Road, Building 3, Floor 4, Little Rock, AR 72212. To be considered eligible, AMOE entries must be postmarked by July 20, 2021. Kinetic is not responsible for lost entries. Only one AMOE entry allowed per person.

Prizes: The Winner will be chosen after the contest period closes and announced on August 2, 2021. Kinetic will give away the following products and services to one (1) randomly selected Participant: 1.) One (1) year of free Kinetic Broadband (at current market rack rates, including entry speeds of (50mbps/200mbps/400mbps – depending on local market availability) or b.) for current Windstream customers up to a $75 credit per month for 12 months toward current related bill fees. The estimated maximum verifiable retail value of each prize awarded is $2,400.00 for the one winner; with a total value of the prize payout for the contest being $2,400.00. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by Windstream. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Acceptance of prize constitutes permission for Windstream to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

Odds: The odds of winning depend on the number of eligible entries received.

Winner selection and notification: The Winner of the Giveaway will be selected in a random drawing under the supervision of Kinetic. All drawings for all prizes will occur at 12:00 p.m. CT, August 2, 2021, at the headquarters of Kinetic, 4001 N. Rodney Parham Road, Little Rock, AR 72211, from and among timely eligible entries received by Kinetic. The Winner will be notified via email to the email address, cell phone number, or by other contact information used to enter the Giveaway within five (5) days following the winner selection. Kinetic shall have no liability for a winner's failure to receive notices due to winner’s spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within fifteen (15) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, prize may be forfeited, and an alternate winner may be selected. The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY.

Rights Granted by You: By entering this contest you understand that Kinetic, anyone acting on behalf of Kinetic, or its respective licensees and successors will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

Terms: Kinetic reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) determine a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Kinetic may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Windstream. Windstream reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website, or violates these Terms & Conditions. Kinetic has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses or cellular phone; multiple entries from the same computer in excess of that allowed by the Giveaway rules; or the use of bots, macros, scripts or other technical means for entering. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE STATE OF THE RESIDENT OF THE PARTICIPANT, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES.
